Cruel punishment entails harshpunishment meted to the inmates while they are in custody. An example is the use of electricchair or use of non-lethal electric bolts. Death penalty should also be put in this category.Prisons are used to separate the inmates from the society and rehabilitate such offenders toenable them correct their behaviour. Cruel and unusual punishments are meted to offenderswhen the nature of crime committed is too cruel. A terrorist or serial killers are examples ofoffenders who are confined under the cruellest conditions.Deliberate indifference boarders on a carefree attitude where a person acts in utterdisregard of the consequences of his actions. It goes beyond mere tort of negligence andseeks to ascertain whether there is gross violation of the rights of an inmate by a professional.The application is of this standard is necessary as it safeguards the rights of inmates.
